1. Acceptance of Terms

By accessing or using Workreap LLC (“Workreap,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). These Terms govern your use of our website, platform, and services.

We reserve the right to update or modify these Terms at any time. Continued use of Workreap after changes are made constitutes acceptance of the most recent version of the Terms.

1.1 Binding Agreement to the Most Recent Terms

You acknowledge that you are bound by the most recent version of Workreap’s Terms of Service. Workreap reserves the right to modify these Terms at any time. Users will be notified of updates via:

  • Email notification (for registered users).
  • A notice on our website (for all visitors).
  • The latest version will always be available on our website.

If you do not agree to the updated Terms, you must discontinue use of the platform.

2. Description of Services

Workreap provides an online freelance marketplace where businesses and individuals (“Employers”) can connect with freelancers (“Talent”) to collaborate on various digital projects. Workreap serves as an intermediary but is not a party to contracts between Employers and Talent.

Account Types:

  • Employer Account – Used to post jobs, hire Talent, and manage projects.
  • Talent Account – Used to offer services, submit proposals, and complete freelance work.

3. Account Registration & Eligibility

3.1 Eligibility

  • Users must be 18 years or older or have reached the legal age in their jurisdiction.
  • By creating an account, you confirm that the information provided is accurate, complete, and up to date.
  • Workreap reserves the right to suspend or terminate accounts that violate these Terms.

3.2 Identity Verification & Anti-Money Laundering (AML) Compliance

To maintain platform security, Workreap may request identity verification from both Employers and Talent. This may include:

  • Government-issued ID verification
  • Proof of residence (utility bill, lease agreement)
  • Payment method verification

Workreap reserves the right to conduct Know Your Customer (KYC) and Anti-Money Laundering (AML) checks in compliance with relevant financial regulations. Failure to provide requested verification may result in restricted access or account suspension.

4. User Responsibilities

By using Workreap, you agree to:

  • Use the platform legally and ethically.
  • Provide accurate and truthful information.
  • Not engage in fraudulent or deceptive behavior.
  • Comply with all applicable laws, including GDPR, CCPA, and other data protection regulations.

Prohibited activities include:
❌ Posting false or misleading job listings
❌ Circumventing Workreap’s payment system
❌ Engaging in hate speech, discrimination, harassment, or illegal activities
❌ Using bots, automation, or scraping tools to manipulate data or rankings

Workreap reserves the right to suspend or ban users engaging in prohibited activities.

5. Non-Circumvention Policy

Users agree not to circumvent Workreap’s payment system by making direct payments outside the platform. Any attempt to negotiate, accept, or send payments off-platform may result in account suspension or termination.

6. Payments & Fees

6.1 Payment Processing

All payments between Employers and Talent must be processed through Workreap’s secure payment system. Payments made outside of Workreap violate our policies and may result in account suspension.

6.2 Fees for Talent (Freelancers)

Talent is charged a commission on earnings as follows:

  • 15% on the first $500 earned per client
  • 7.5% on earnings between $500 and $10,000
  • 3% on earnings exceeding $10,000

6.3 Fees for Employers

Employers are charged a 3% service fee on all payments made to Talent, with a minimum fee of $1.50 per transaction.

6.4 Refunds & Disputes

  • Refunds are not automatically provided and must be agreed upon by both parties.
  • Workreap may assist in disputes but does not guarantee resolution.

7. No Guarantee of Work or Earnings

Workreap does not guarantee job availability, earnings, or successful contract completion. Talent acknowledges that their earnings depend on client demand, competition, and market conditions.

8. Intellectual Property Rights

  • Employers own rights to work delivered by Talent after full payment.
  • Talent retains rights to pre-existing materials used in project delivery.

9. Service Availability & Platform Downtime

Workreap strives to maintain platform availability but does not guarantee uninterrupted access. We may temporarily suspend services for maintenance, upgrades, or unforeseen technical issues. Workreap is not liable for losses resulting from downtime.

10. Compliance with International Laws

Users must ensure their use of Workreap complies with all applicable local, national, and international laws, including employment, tax, and digital services regulations.

11. No False Reviews or Reputation Manipulation

Users may not post fake reviews, manipulate ratings, or engage in review exchanges to boost their profile. Workreap reserves the right to remove suspicious reviews and take disciplinary action.

12. Account Termination for Inactivity

Workreap reserves the right to deactivate accounts that remain inactive for 12 months. Users may reactivate accounts by logging in or contacting support. After 24 months of inactivity, accounts may be permanently deleted.

13. Indemnification

Users agree to indemnify and hold Workreap harmless from any claims, disputes, losses, or legal actions arising from interactions between Employers and Talent, including contract disputes, non-payment, or unsatisfactory work.

14. Right to Refuse Service

Workreap reserves the right to refuse service to anyone at our discretion. We may suspend or terminate accounts without notice if we determine that a user violates these Terms or engages in behavior that harms the platform.

15. Force Majeure Clause

Workreap is not liable for delays or failures due to events beyond our control, including:

  • Natural disasters
  • Cyberattacks
  • Power outages
  • Government actions

16. AI-Generated Content Disclaimer

Workreap is not responsible for the accuracy, originality, or ethical implications of AI-generated content provided by Talent. Employers must verify AI-based work.

17. Governing Law & Contact Information
